Terms of Use and Membership Agreement

6.1. Parties and acceptance

These terms are between RATE EXTRA TOURISM L.L.C ("Otelyar"), which operates otelyar.com, and the person using the site or becoming a member (the "User"). By using the site or ticking the box on the membership form, you accept these terms. Bookings are also governed by the Distance Sales Agreement and the Cancellation and Refund Policy.

6.2. The service

Otelyar is an online booking service selling hotel accommodation to individual customers. Hotel content, photos, facilities and ratings come from suppliers and hotels; Otelyar makes reasonable efforts to keep them up to date. Photos are illustrative. For the terms of a booking, the information shown at the payment step prevails.

6.3. Membership

6.3.1. You must be at least 18 years old to become a member. Bookings can also be made without membership.

6.3.2. You are responsible for the accuracy and currency of the information you provide. You must keep your login details confidential and report any unauthorised use to destek@otelyar.com without delay.

6.3.3. The account is personal and non-transferable. You may close your account at any time in the account settings or by writing to destek@otelyar.com. Closing the account does not cancel existing bookings.

6.4. Rules of use

The User may not use the site for unlawful purposes, make unauthorised bookings on behalf of others, pay with fake or stolen cards, crawl the site or harvest its content with automated tools, make bulk bookings for resale, attempt to bypass security measures, or misuse the Defne support assistant.

6.5. Intellectual property

The site's design, software, the "Otelyar" brand and content owned by Otelyar belong to Otelyar. Hotel images and content belong to their respective owners. They may not be reproduced except for personal use.

6.6. Suspension

Otelyar may suspend or close an account in case of breach of these terms, suspected fraud or at the request of the payment institution. Your rights in confirmed bookings are preserved; in case of fraud, the relevant booking may be cancelled and the competent authorities notified.

6.7. Limitation of liability

The site is provided "as is"; uninterrupted operation is not guaranteed. Otelyar is not responsible for the content of third-party sites linked from the site. This article does not limit the mandatory provisions of applicable consumer law or Otelyar's liability for wilful misconduct or gross negligence.

6.8. AI support assistant

Defne on the site is an AI assistant. General information given by Defne does not change booking terms; the terms shown at the payment step and in the confirmation email are binding. Details are in the AI Support Notice.

6.9. Changes

Otelyar may update these terms. Material changes are notified to members by email at least 15 days before they take effect. Changes do not affect the terms of confirmed bookings.

6.10. Governing law

These terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai, without prejudice to the mandatory consumer protection provisions of the User's country of habitual residence. The dispute channels in Article 13 of the Distance Sales Agreement apply.

6.11. Membership checkbox

"I have read and accept the Terms of Use and Membership Agreement. I understand that my personal data will be processed as described in the Information Notice."
